Abstract [sv]

I denna uppsats undersöks nödvärnsrättens utveckling i svensk rätt från

medeltiden fram till den utvidgning som nu föreslås genom Dir. 2025:82.

Undersökningen har tre frågeställningar. Den första gäller hur gränsdragningen

mellan statens våldsmonopol och den enskildes rätt till självförsvar har utvecklats

och vilka rättsliga uttryck den har fått i lag, förarbeten och praxis. Den andra gäller

vilka samhälleliga, ideologiska och rättstekniska faktorer som kan förklara att

bestämmelserna fått den utformning de har under respektive epok. Den tredje

gäller vilka återkommande trender, argument och spänningar som kan urskiljas

genom historien, och i vilken utsträckning den nu föreslagna utvidgningen kan

förstås som ett led i en längre linje. Genom hela framställningen följer tre teman,

nämligen försvarlighetsbedömningens utveckling, hemfridens särställning och den

ideologiska spänningen mellan den enskildes trygghet och rättsordningens intresse

av att inte trappa upp våldet.

Abstract [en]

This thesis examines the development of the law of self-defense in Sweden from

the Middle Ages to the expansion currently proposed in Government Directive

2025:82. The study is guided by three research questions. The first concerns the

evolution of the boundary between the state's monopoly on the legitimate use of

force and the individual's right of self-defense, and the ways in which this

boundary has been articulated in legislation, preparatory works, and judicial

practice. The second concerns the societal, ideological, and legal-technical factors

that may explain the particular form that self-defense provisions have taken during

different historical periods. The third concerns the recurring trends, arguments, and

tensions that can be identified across time, and the extent to which the proposed

expansion may be understood as part of a longer historical development. Three

themes run throughout the thesis: the evolution of the proportionality and2reasonableness assessment underlying the law of self-defense, the special status

accorded to the sanctity of the home and the ideological tension between the

individual's security and the legal order's interest in preventing the escalation of

violence.
