Between children's wishes and social worker's responsibility : Social worker's interpretation of the principles of "the best interest of the child" and "respect for the views of the child's opinion" (English)
Abstract [en]
"The best interests of the child" and "respect for the views of the child’s opinion" are two principles rooted in the UN Convention on the Rights of the Child, which have also been incorporated into Swedish legislation. Due to the broad formulations of these principles, they prove difficult to define. This place demands on social workers within social services to apply their knowledge to transfer these principles into concrete investigative situations. This study is based on semi-structured interviews with the material analyzed through a thematic analysis. The findings reveal that the broad formulations of the principles and the lack of guidelines create considerable discretionary space for social workers when applying these principles in practice. This carries a risk that the principles are interpreted and applied differently in practice, potentially resulting in varying assessments. At the same time, it becomes apparent that conflicts can arise between the child's expressed wishes and social workers' assessments of what is considered to be in the child's best interests. In these situations, communication and relationship-building emerge as central elements. It is evident that social workers rely heavily on experience-based knowledge and collegial support when interpreting the principles. Assessments are therefore shaped not only by legislation and formal guidelines, but also by practical experience and individual interpretations.

”Barnets bästa” och ”hänsyn till barnets åsikt” är två principer som har sin grund i barnkonventionen men som även är integrerad i den svenska lagstiftningen. Till följd av principernas breda formuleringar framkommer det att dessa principer är svåra att definiera. Detta ställer krav på socialsekreterare inom socialtjänsten att använda sin kunskap i arbetet för att omsätta dessa principer i konkreta utredningssituationer. Denna studie bygger på semistrukturerade intervjuer där materialet har analyserats genom en tematisk analys. Resultatet synliggör att principernas breda formuleringar och brist på riktlinjer medför ett stort handlingsutrymme för socialsekreterare att applicera dessa principer i praktiken. Detta medför en risk att principerna tolkas och tillämpas olika i praktiken och därmed även riskerar att resultera i olika bedömningar. Samtidigt synliggörs det att det kan uppstå konflikter mellan barnets uttryckta vilja och socialsekreterares bedömningar av vad som anses vara barnets bästa. I dessa situationer framstår kommunikation och relationsskapande som centrala delar. Det framgår att socialsekreterare i stor utsträckning använder erfarenhetsbaserad kunskap och kollegialt stöd i arbetet med att tolka principerna. Bedömningarna formas därav inte enbart genom lagstiftning och formella riktlinjer utan av praktisk erfarenhet och individuella tolkningar.
