Abstract [en]

Property law is not a static legal institution but continuously evolves in response to changing social, political, and normative conditions. Contemporary property theory increasingly emphasizes the role of property law in accommodating democratic values and societal transformation. At the same time, developments in international human rights law, particularly the growing influence of third-generation rights emphasizing collective interests, environmental protection, indigenous claims, and sustainable development, have introduced new value-based considerations into traditionally formal and state-centred legal systems.

This article examines how such developments affect Swedish property law. It argues that although Swedish real property law remains largely structured around formal legal certainty and state-centred authority, recent legal developments reveal growing tensions between this formal framework and emerging normative claims grounded in human rights and collective interests. These tensions raise broader questions regarding the capacity of property law to maintain internal coherence while accommodating changing societal values.

To illuminate these issues, the article places contemporary developments in a historical perspective. Drawing on established legal-historical scholarship, it highlights earlier periods in Swedish property law in which custom and locally embedded normative structures played a more significant role in regulating rights in land. The historical discussion serves as a point of comparison rather than an independent historical inquiry, illustrating how shifts in the normative foundations of property law have previously been absorbed within the legal system.

The article concludes that current developments may be understood as part of a longer trajectory of transformation in which property law repeatedly adapts to changing conceptions of legitimacy, authority, and justice. Historical experience therefore offers valuable perspectives for understanding the ongoing interaction between formal property structures and increasingly prominent value-based claims.
