    Abstract [en]

    The dissertation investigates health care professionals’ freedom of religion and belief. The overarching aim is to examine the rights or freedoms of health care personnel to work in accordance with their convictions while their employers – the care providers (caregiver) – have responsibilities to fulfill the legal requirement to provide patients good care. The thesis focuses on certain situations in which health care personnel do not want to provide some care, service, or information in light of their beliefs or conscience – described as conscientious objections in health care.

    The study analyses traditional legal sources, such as statutes and regulations, preparatory works, court decisions, and agency practice, as well as scholarly work (doktrin), with the goal of investigating the juridical possibilities for personnel to work in accordance with their religion or beliefs. These materials are not, however, used simply to ascertain the applicable law, but also to canvass the types of conflicts of interest that they identify, to further elucidate the interests of different actors in health care – the care provider, health care personnel, and the patient. One of the purposes of this thesis is to demonstrate how different conflicts of interest may come to light when personnel refuse, for religious and moral reasons, to participate in certain forms of health care and other duties associated with providing that care.

    The question of whether health care personnel’s religiously based actions or inaction will be allowed as derogations from general requirements ultimately turns on the possibilities, in each case, to find a reasonable balance between personnel’s religious interests and the patient’s interest in obtaining good and safe care on equal terms. The caregiver plays a key role in determining personnel’s exemptions from their tasks in accordance with their beliefs. However, the author suggests that the Government should clarify the responsibilities that a care provider has regarding conscientious objections, as well as what the personnel who wish to be free from participation in certain care may expect in the consideration of such requests.

    Hälso- och sjukvårdspersonalens rättsliga möjligheter att agera i enlighet med sin religion eller tro i arbetslivet har på senare år blivit föremål för såväl rättslig som politisk debatt. En särskilt debatterad fråga är huruvida hälso- och sjukvårdspersonal bör ges tillfälle att av religiösa skäl avstå från att medverka vid viss vård. I denna artikel behandlas s.k. samvetsklausuler, dvs. regler som ger hälso- och sjukvårdspersonal en rätt att befrias från att medverka vid eller utföra viss vård på grund av samvetsbetänkligheter. Fokus ligger på situationen när personal uttryckligen vägrar att medverka i abort­verksamhet, då abort många gånger beskrivs som en moraliskt känslig vårdåtgärd som kan ge upphov till samvetsbetänkligheter i större utsträckning än andra vårdåtgärder. Dessutom har flera europeiska länder infört samvets­klausuler i förhållande till just abort. Som exempel har både Norge och Danmark infört samvetsklausuler, vilket kortfattat behandlas. Därutöver redogörs för två aktuella fall vid svensk domstol om abortvägran och Europadomstolens inställning till samvetsklausuler.

    The Rights of Children in Biomedicine: Challenges posed by scientific advances and uncertainties2017Report (Other academic)
    Abstract [en]

    The Committee on Bioethics of the Council of Europe commissioned this study to identify potential areas of heightened concern for the rights of children that may be unfavorably affected by scientific advances and uncertainties in biomedicine. This report is the result of that study. It provides substantive illustrations of the diversity of problems generated by biomedical developments, including the expanded use of certain biomedical procedures, emerging technologies, and innovative therapies. It also addresses uncertain risks to children through the continuation of longstanding biomedical practices that lack sufficient scientific support. Because considerable legal protections have been developed for biomedical research and continue to be debated in great depth, this report focuses more broadly on biomedicine as a whole. The specific concern addressed here is not about the research process and regulation as such, but rather on how scientific advances and risk-laden practices reach children in biomedicine – whether through health care practices or in other biomedical settings. Mapping out the areas of concern for this report required not only identifying the technological advances and scientific challenges at stake but contemplating these challenges first and foremost from the perspective of the rights of children as class – formally collectively defined as persons from birth to age 18, unless they have attained majority status. Because a subsequent report will analyze the potential legal frameworks protecting children from the scientific risks and uncertainties identified here, this report identifies the challenges in protecting children relative to those rights that are commonly described in international human rights discourse, with only summary references to specific legal instruments in the report’s conclusions. The aim of the report is to demonstrate how the scientific risks and uncertainties illustrated here may affect the rights of children from birth through adolescence, in a variety of ways. Chapter 2 surveys differences in childhood development to illustrate why the lack of protection from scientific risks and uncertainty persists, in part because of limited understanding of the developmental differences and vulnerabilities of children at different phases of life. The report then expands on how many interventions may reach children at the earliest stages of their development, such as through assisted reproduction and other interventions in utero (Chapter 3) as well as in the field of genetics (Chapter 4). The report then addresses children who have been subjected to high-risk and controversial clinical practices, many of which lack sufficient scientific support regarding their safety. Among those children at risk are sexual or gender minority children (Chapter 5) and children diagnosed with serious physical and mental health needs (Chapter 6). The next chapters address two areas affecting critically ill children where considerable policy debate has taken place, but without sufficient regard to scientific advances and uncertainties, specifically in transplantation (Chapter 7) and end-of-life decisions (Chapter 8). In the final chapter, the report sets forth numerous rights of children in biomedicine that are currently at stake from scientific advances and uncertainties – not only the right to the highest attainable standard of health but rights protecting their physical and psychological integrity and their privacy and identity, as well as freedom from discrimination. The landscape of these rights is as vast and potentially complex as biomedicine. The report thus concludes that the biomedical controversies surveyed here signal a need for systemic, continuous and multidisciplinary oversight of these issues, as well as for many biomedical interventions that could not be covered here in depth. These matters cannot be left to biomedical expertise alone, but instead require vigilant oversight from human rights authorities and scholars with an understanding of these issues.

    Abstract [en]

    Currently, Quebec is the only province in Canada, which has taken a decision on legalizing euthanasia and physician assisted suicide. In Quebec euthanasia and physician assisted suicide are labelled as medical aid in dying and perceived as a part of healthcare. However, in Canada, at the federal level, euthanasia and physician assisted suicide remain punishable under the Canadian Criminal Code.

    This article examines Quebec’s legal approach to medical aid in dying, highlights some of the legal challenges, and discusses the need to handle them. The authors first provide a brief background of the euthanasia and assisted dying debate in Canada and particularly in Quebec. Further, they explain the concept of medical aid in dying and analyse the criteria for accessing it. Then they move on to analysing the constitutional legality of the Bill 52, an Act respecting end-of-life care allowing for medical aid in dying and possible legal consequences a physician might face if medical aid in dying is provided.

    An Introduction to Islamic Securities (Sukuk)2017Report (Other academic)
    Abstract [en]

    Islamic securities (Sukuk) are hybrid securities bearing features of stocks and bonds, altogether. Similar to stocks, they indicate a type of partner-ship and holders of Sukuk will be considered as the owners of underlying asset or project for finance of which, Sukuk have been issued. Theoreti-cally, these holders share any loss and profit resulted from underlying asset. However, these securities usually bear a maturity date like bonds and contrary to stocks. The holder has no voting right or control over the underlying asset. In case of bankruptcy and contrary to the share-holders, holder benefits from priority right over underlying asset, in comparison to other creditors. Practically and contrary to the initial theo-ry in consideration of Sukuk (sharing in loss and profit), nowadays some of these securities are usually of fixed revenue and any probable risk re-sulting from decrease being made in the value of underlying asset will be covered by the issuer or originator, through insurance companies. Now-adays, new forms of Sukuk such as convertible, preference, subordinated and perpetual Sukuk have been developed, features of which are very similar to hybrids. Considering special nature of Sukuk, indicating partial ownership of its holder over related underlying asset or project, some-how we may use these new hybrid tools to prevent prevailing risks relat-ed to other securities and hybrids, such as credit and bankruptcy risks; and, we may use them more in financing and attracting capital, globally.

    Hur barnets bästa och barnets rättigheter ska få större genomslag i vårdnadstvister är ständigt aktuellt för granskning och revision. Vårdnadstvister innefattar ofta svåra konflikter mellan föräldrarna och barnet utsätts ofta för ett större psykiskt lidande än vad separationen i sig självt medför. Bidragande till detta kan vara att vissa brister fortfarande existerar i vårdnadsprocessen. Dessa brister medför att handläggningsordningen bör ses över. Ett alternativ som varit på tal många gånger för svensk del är en specialiserad domstol för familjerättsmål och vårdnadstvister. Förslaget har dock avvisats flera gånger. Även om efterfrågan på specialisering i viss mån ökat i Sverige de senaste decenniet fortsätter generalisering hos domarna vara utgångspunkten. Speciella familjedomstolar är en ordning som ansetts motiverad i många andra länder. Bland länderna som instiftat specialisering i familjerättsliga ärenden finns Nya Zeeland. Vårdnadstvister handläggs där i en familjedomstol med specialiserade domare. Landet har genomfört flertalet reformer av domstolskonstruktionen och vårdnadsprocessen för att komma tillrätta med diverse brister, såsom långsamma processer och bristande kompetens hos personalen. Samma problem kan i viss mån sägas existera också i den svenska vårdnadsprocessen och kan innebära att barnets rättigheter inte tillgodoses fullt ut. Med utgångspunkt i dessa brister finns det en poäng i att åter lyfta frågan om en specialiserad familjedomstol.

    Abstract [en]

    The thesis deals with the right of property as defined in Article 1 of the First Protocol to the European Convention on Human Rights. It has two main purposes. The first is to examine the case law that has developed since the important case of Sporrong and Lönnroth in 1982. The second is to ascertain the degree to which the right of property is dependent on the structure of society and the existence of democracy.

    Many legal issues are examined in the thesis. One essential question concerns the concept of property itself. What kinds of economic interests are protected? Are there any limits to the protection of interests of economic value? What are the implications of interpreting the concept widely? Another important issue is the conditions under which the State may interfere with individual property rights. It is generally accepted that compensation should be paid when an individual is deprived of property. But what criteria govern the amount of compensation necessary to comply with the Convention? What is meant by full compensation? When, if so, can the State avoid liability to pay compensation? The public purpose clauses in Article 1 are also examined. How does the European Court of Human Rights interpret this wide notion of public purpose? Can the State lay claim to any interests it considers worth protecting? Does redistribution of wealth fall within what is meant by publicpurpose? The right of property also come into play when the State taxes its citizens. The question is whether the Convention sets any limits on taxation and, if so, what they are. Are there any limits on high and accumulated taxes? Are there any limits on the purposes for which the taxes are levied? Finally, what role does the principle of proportionality play when interpreting Article 1? Does it mean that the other criteria in Article 1 are subordinate?

    The thesis also examines the historical and philosophical background of the right of property. Throughout ages there has,been a never-ending discussion as to the role and implications of protecting private property as opposedto an alternative kind of society, based on collective or common ownership. How have these ideas influenced modem protection of property rights?

    Jag har av Rädda Barnen blivit ombedd att utreda frågan om att inkorporera Barnkonventionen med svensk rätt. I detta uppdrag ingår enligt uppdragsbeskrivningen att ”sammanställa ett faktaunderlag och en analys i frågan. Vidare ska en redogörelse av orsakerna till att Sverige valt att inkorporera vissa internationella dokument tas fram, samt en jämförelse med några länder som har inkorporerat Barnkonventionen, framförallt Norge, göras. Avslut-ningsvis ingår att problematisera kring för- och nackdelar med att inkorporera Barnkonventionen.” I det följande kommer jag att redovisa hur Barnkonventionen har behandlats i svensk rätt. Därefter redovisar jag vilka erfarenheter som finns från inkorporationen av Europakonventionen (den europeiska konventionen angående skydd för de mänskliga rättigheterna och de grundläggande friheterna), med svensk rätt. Det norska exemplet med Barnkonventionen lyfts sedan fram. Avslut-ningsvis redovisas olika argument för respektive emot inkorporation och vilka argument som får anses väga tyngst. Inledningsvis beskriver jag i korta ordalag hur internationella konventioner behandlas i svensk rätt.

    Abstract [en]

    This thesis deals with the conditions pursuant to which a Swedish company limited by shares(aktiebolag) is not bound by acts from the company representatives (the board of directors, themanaging director and special company representatives, (särskilda firmatecknare) according tothe provisions set out in chapter 8 section 14 of the Swedish Companies Act (aktiebolagslagen(1975:1385)), Said provisions govern the legal effects of contracts and other legal transactionsentered into by the company representatives and who, in so doing, exceed their authority or actin breach of their internal duties.

    Main issues in the thesis are to be identify the provisions of the Act that are of relevance to therepresentatives authority and the rules governing their internal duties, to analyse the content ofthese provisions and rules and how they relate to other rules in Company Law that can make acontract void, e.g., rules about the companies capacity, statutory prohibitions and closely relatedrules about representation and signing for the company.

    It is argued that the provisions in the Act on authority are those which deal with thedistribution of functions between the company organs. If the board of directors enter into a legaltransaction in which the Act requires a resolution by the general meeting of shareholders, e.g., amendment of the articles of associaton, it exceeds its authority (an act out of scope of themanagement of the company affairs). Similary, the managing director exceeds his authority ifhe enters into legal transactions in an area where the Act stipulate that the decision in questionshould be taken by the board of directors (steps which with regard to the scope and nature of thecompany's operations are unusual or of great importance).

    The content of the representatives internal obligations is determined by the contractualrelationship between the representative and the company. Express terms of this relationship areto be found in instructions from superior organs and in the articles of association. Implied termsare found in mandatory and non mandatory provisions concerning the representatives duties,such as the provisions on function-distribution, on-proceedings for board meetings, on selfdealing, on equal treatment of shareholders, on undue advantages to shareholders or third partiesto the detriment of the company or other shareholders and ultimately, in the general rulesapplicable to fiduciary relationships.

    Other issues dealt with are the requirements in chapter 8 section 14, that the representativeshould have "acted" (acts of receiving are not covered by the word of the provision), that heshould have entered into a "legal transaction" (does the provision apply to all kinds of legaltransactions?) and that he should have acted on "behalf of the company" (and not for himself orsomeone else). Also the requirement of bad faith of the third party is discussed as is the legaleffect of the company not being bound by an act.

    Abstract [en]

    The paper deals with the problem of axiomatizing three formal systems of Deontic Logic / Normative Logic in a sense derived from Alchourron & Bulygin (1973) and Alchourron (1969). First of all we consider a version DL of their Deontic Logic (= Logic of Norms), secondly a version NL of their Normative Logic (= Logic of Norm-Propositions), to which they add a number of definitions generating certain normative operators "proper". Thirdly, we deal with a third system NOBL constructed with a view to isolating the normative fragment of NL which arises as a result of adding those definitions to NL. The main outcome of this paper is then a representability result to the effect that the set of sentences provable in NOBL is exactly the set of the sentences which are provable in NL on the basis of those definitions. The distinction Logic of Norms vs. Logic of Norm-Propositions is explained and discussed rather informally both in the introduction and in the concluding section of the present paper.

    In an earlier paper by the author, angstrom qvist (1999), I presented an approach to the logic of historical necessity, or inevitability, in the sense of a two-dimensional combination of tense and modal logic for worlds, or histories, with the same time order, known as T x W logic. Distinctive features of that approach were, apart from its two-dimensionality, its being based on discrete and finite time, and its use of so-called systematic frame constants in order to enable us to indicate longitudes (x-values) and latitudes (y-values) of any points in the co-ordinate systems under consideration. This led us to study and axiomatize an infinite hierarchy HTWxy of two-dimensional modal tense logics with the characteristic operators for historical necessity and possibility added to the original basic vocabulary. The main purpose of the present paper is then twofold: (A) to extend the logics HTWxy to the interesting branch of philosophical logic constituted by deontic logic as combined with tense (or temporal) logic; and (B) to deal with a curious puzzle known as the so-called epistemic obligation paradox - a well known stumbling-block in this area of research in philosophical logic. We argue for a solution to both these problems, which appeals to a new infinite hierarchy DHTWxym of extensions of the HTWxy in the sense of logics combining dyadic deontic modalities with temporal ones such as those for historical necessity and other two-dimensional modalities.

    The paper deals with the problem of axiomatizing a system τ1 of discrete tense logic, where one thinks of time as the set Z of all the integers together with the operations +1 (“immediate successor”) and -1 (“immediate predecessor”). τ1 is like the Segerberg-Sundholm system W1 in working with so-called infinitary inference rules; on the other hand, it differs from W1 with respect to (i) proof-theoretical setting, (ii) presence of past tense operators and a “now” operator, and, most importantly, with respect to (iii) the presence in τ of so-called systematic frame constants, which are meant to hold at exactly one point in a temporal structure and to enable us to express the irreflexivity of such structures. Those frame constants will be seen to play a paramount role in our axiomatization of τ1.

    The paper presents an infinite hierarchy PRm [m = 1, 2,...] of sound and complete axiomatic systems for modal logic with graded probabilistic modalities, which are to reflect what I have elsewhere called the Bolding-Ekelof degrees of evidential strength as applied to the establishment of matters of fact in law-courts. Our present approach is seen to differ from earlier work by the author in that it treats the logic of these graded modalities not only from a semantical or model-theoretic viewpoint but from a proof-theoretical and axiomatic stance as well. A paramount feature of the approach is its use of so-called systematic frame constants as labels of diverse grades of probability. Apart from this novel feature our approach can be seen to go back to pioneering work by Lou Goble in 1970.

    We consider a version of so called T × W logic for historical necessity in the sense of R.H. Thomason (1984), which is somewhat special in three respects: (i) it is explicitly based on two-dimensional modal logic in the sense of Segerberg (1973); (ii) for reasons of applicability to interesting fields of philosophical logic, it conceives of time as being discrete and finite in the sense of having a beginning and an end; and (iii) it utilizes the technique of systematic frame constants in order to handle the problem of irreflexivity in tense logics, well known since Gabbay (1981). Axiomatizations are given for two infinite hierarchies of two-dimensional modal tense logics, one without and one with the characteristic operators for historical necessity and possibility. Strong and weak completeness results are obtained for both hierarchies as well as a result to the effect that two approaches to their semantics are equivalent, much in the spirit of Di Maio and Zanardo (1996) and von Kutschera (1997).
