    Abstract [en]

    The present study has a three folded focus, framed by one over all aim; to critically discuss and evaluate the constructions of women’s legal subjectivity in dominant feminist discourses on prostitution and trafficking. First, I set out to develop a gender theoretical understanding of prostitution. I relate prostitution to a context of reproduction and gender, where the separation between women’s sexuality and reproduction is understood as operating as creating a split femininity, and likewise to construct a unified masculinity. Secondly, I examine the discursive orders on prostitution and trafficking. I examine the frameworks of thought on prostitution and trafficking as they have been formulated in an international debate (on international law) during the last decades. Thirdly, focusing on the discourse that seeks to normalise prostitution as sex work, I examine how the creation of women's legal personhood with in this discourse takes place through an oscilliation between discursive orders on prostitution and trafficking, emphasizing some times different and conflicting ways of promoting women’s rights. One crucial question is how understandings of prostitution, when transposed to a context of trafficking, are expressed through a "judicial reasoning", and how these expressions might shed light upon the construction of women’s legal standing. The aim of the dissertation is to contribute to a comprehensive feminist theoretical understanding of the relation between, on the one hand, different positions on prostitution and trafficking within international law, and the discourses disputing its substance on the other.

    Summary

    Since the American “Sex Wars” were fought in the 80’s between different strands of feminism, feminists have been arguing about how to interpret the issue of prostitution. The positions taken differ in points of departure, analytical focus, epistemological claims and of course in suggested solutions. This article examines this heated debate, as articulated within the Western context during the last some twenty years, suggesting a way of structuring it. Using distinctions such as analytical-empirical, pragmatic-idealistic and fragmented-coherent, I discuss how the different approaches to the issue of prostitution are phrased. In the article, I discuss six key points of conflict.

    1. Is prostitution understood as a) purely an act or b) also as a gendered institution, with an impact on society as a whole?

    2. Who is visible in the discussion about “prostitution”? a) Women in prostitution, who are made equivalent with prostitution, or b) the buying men, who are seen as key actors in prostitution?

    3. How is “the whore” interpreted? As a) an empirical figure, embodiedby the sex working woman, breaking gendered norms, or as b) a gendered filter of interpretation through which women are measured and constructed as women, manifesting gendered norms?

    4. How is prostitution understood? “Per se”/in idealistic terms or as it manifests it self/in a pragmatic terms? In other words, is prostitution a) taken to be impossible to abolish but possible to reform, as to become what it really is – sex work – or is it b) seen as important to make fundamental changes in society, which can’t come about as long as prostitution is accepted?

    5. What is seen as negotiated in the prostitution contract? Is it a) sex that is bought and sold, or is it b) women’s sexual but non reproductive bodies, i.e. women’s accessibility for men?

    6. Is prostitution taken as a) a postulate, laying ground for how we should define politics and policy, or b) as a practice that can and should be challenged and politically contested.

    Making EU Legislation in the Area of Criminal Law: A Swedish Perspective2013Doctoral thesis, monograph (Other academic)
    Abstract [en]

    This dissertation discusses the essential criticisms against the use of EU criminal law from the point of departure that criminal law should ideally be negotiated with a high degree of respect for essential criminalisation principles. The purpose of this is to minimize the risk of over-criminalisation. The dissertation studies four legislative proposals which were submitted by the European Commission in the years between 2006 and 2010 in order to determine to what extent these, as well as the subsequent preparatory legislative materials by the decision-making EU institutions, respected the principles of ultima ratio and the ‘criminal law version’ of the proportionality principle. The ‘criminal law version’ of the proportionality principle requires there to be proportionality between the offence and the penalties, thus it is different from the EU’s general principle of proportionality.

    The case study review is based on the materials which were produced by the European Commission in the preparation of the proposals, as well as on reports by the European Parliament which summarizes its position on the legislative proposals. Finally, the documents which summarize the Council meetings during which the proposals were discussed are reviewed.

    The dissertation also discusses the level of transparency in the European legislative process.

    The dissertation includes a chapter on some essential parts of the Swedish criminal justice system, including a description of how legislation is prepared in Sweden. Another chapter sheds light on the EU’s legislative process, including the amendments made to it in the past decades. This is provided to create a platform for discussion on the ‘status’ of a criminal law which has been negotiated in an international process, although the author mainly leaves it to others to identify possible weaknesses in the system from a criminal justice point of view.

    The dissertation discusses strengths and weaknesses in the EU’s legislative process from the point of departure that the EU legislator has only recently gained a clear competence to adopt substantive criminal law using the ordinary legislative procedure. In view of this, the dissertation focuses on whether or not the EU is responsive to the criticism it receives.

    Abstract [en]

    The balance between the regulatory autonomy of the Member State of the European Union and the requirements of harmonisation as set out in the EU Services Directive (2006/123/EC) is the subject of this work. The overall effects of the free movement of services on national regulatory autonomy as prescribed by the Services Directive is to a great degree dependent upon whether this directive is perceived of as a traditional directive or instead, as a governance instrument to control and steer the actions of the Member States. The Services Directive, on one hand, establishes definitions of what may constitute non-justified national requirements that do not correspond to the established Union acquis interpreting the Treaty Articles on the free movement of services, whereby it could be considered to entail undue alteration or distortion of this acquis. On the other hand, the Services Directive also contains instruments for accomplishing the objectives of the Directive through a new and more profound type of collaboration and mutual evaluation procedures by the Member States in cooperation with the European Commission. If these features are emphasised, the Services Directive is mainly a governance strategy, aiming to steer and control the Member States when regulating the services market. The point of departure in this study is therefore that the Services Directive shows a two-edged character, where both sides are represented.

    The final analysis focuses on the Directive’s potential effects on the Member States’ room for manoeuvrability within their national regulatory autonomy, and what general constitutional implications follows from the adoption of one or the other of these two understandings of the Directive. The thesis demonstrates the complexity of the Union legal system in relation to the obligations set out in the Treaty Articles on the free movement of services. A general conclusion is that the understanding of the Services Directive is signified by the tensions between the interpretations established by the Court in its case law on the free movement of services, the regulatory powers conferred on the Union and the effects of Union law on the national regulatory autonomy.

    Abstract [en]

    Women who abuses alcohol or drugs during pregnancy risk to in different ways harm their unborn child. Diseases - and injury symptoms such as fetal alcohol syndrome, underweight and abstinence are consequences that can be related to the pregnant woman’s addiction. According to swedish law, LVM, there is a possibility to committ alcohol- and drug addicts to compulsory institutional care. However, this can only take place when the reason for the deprivation is to protect the mother from harm, not the fetus.

    The overall purpose of this thesis is to look into the legal status of the fetus and to investigate whether there is a need for a legislation that allows compulsory institutional care for pregnant addicts. The thesis is a legal dogmatic study.

    The bill that was presented in 2009 featured a supplement to existing legislation, where compulsory treatment could be initiated if there was a substiantial risk of harm to the fetus due to addiction. The main concern regarding this type of legislation is how it will effect the pregnant woman’s right to freedom and right of self-determination in relation to the fetus interests. Problems have primarly affected the perception of the fetus legal status and lack of values that determine when birth defects occur.  In Norway the government has managed to legislate in this matter and have a similar rule regarding compulsory institutional care of pregnant addicts. The preventive measures available today are mainly long-term, and for those pregnant women who already suffers from addiction, the aid often arrives too late. A need for such legislation seems to be useful to some extent, but not necessarily the same legislation as the one in the bill from 2009.

    Abstract [en]

    A large part of the criminal process consists of interrogations. These are often held both during the preliminary investigation and in court, with both parties and witnesses. The essay is focused on the preliminary investigation. In addition to interrogations preliminary investigation protocols are also discussed, since interrogations during the investigation is supplied to these protocols.

    The essay starts with the fundamental law of evidence. The free concept of evidence is discussed together with rights that are fundamental for the criminal process. Preliminary investigations are thereafter treated because of their importance for the essay. Interrogations and preliminary investigation protocols are in focus, these are described and are a basis in the essay.

    NJA 2015 s. 702 and Göta Hovrätt, mål nr. B 1417-16 are discussed in section four. In both cases the court expresses dissatisfaction over poor investigations. The court mentions factors that aren’t strictly legal factors. These factors are derived from behavioural research and are described as important in the preliminary investigation. The cases are described and analysed.

    Risk factors that have the possibility to affect the quality of the investigation are treated in section five. These factors can be of importance throughout the legal process. Confirmation bias is in focus. It’s the foundation to potential difficulties for the investigators. Instead of having suspects, victims and witnesses as investigation items, the essay focuses on investigators. Confirmation bias is the basis for a large number of factors that may affect investigators. These factors are examined separately. Interestingly, the investigators aren’t always aware of the risk factors, which make them more difficult to detect. In the same section risk factors that investigators can expose to others in interrogations are treated. Again, in most cases the investigators are unaware of these factors. Confirmation bias and other cognitive phenomena contribute to these factors, which are described and analysed. There is also a short chapter containing an interview with an investigator and my own experiences from my thesis internship. The section concludes with an analysis of risk factors, their importance during interrogations and how the preliminary investigation protocol can be affected. Protocols can be used as evidence in court and therefore it’s of importance to examine them.

    Possibilities to help investigators to avoid influence from risk factors are treated in the final section. Solutions are presented and discussed. It’s hard but possible to curbthe effect of risk factors.

    Abstract [en]

    Corporate Social Responsibility (CSR) is a topic of rising importance in the current human rights discussion. As multinational supply chains have a growing impact on people’ lives, both in more developed and developing countries the question of how to regulate the behaviour of the companies that engage in these supply chains becomes increasingly important. States have tried to do this through both national and international law, by introducing hard law regulations as well as voluntary frameworks, so called soft law initiatives. The general legal framework of international law will first be introduced and subsequently focus will lie on the United Nations Principles on Business and Human Rights (The UN Guiding Principles) concerning the social responsibility of companies. In this thesis, the second of these sections is explored through an investigation into what responsibilities financial institutions, institutions that provides financial services for its clients or members, can be considered to have according to the legal framework associated with the corporate responsibility of human rights. The position of financial institutions is unique in a supply chain due to their distance to the production and hence to the country wherein the most fundamental human rights risks are present. Meanwhile, these financial institutions are also key to the trade operating throughout the supply chain. The thesis will identify the human rights issues along a supply chain and investigate the subsequent responsibilities that are tied to the financial institutions. The primary objective of the thesis is to clarify how to apply the international framework to the financial institutions and provide an answer to the question of what the human rights responsibilities of financial institutions are along a supply chain and to answer the question: what are the human rights responsibilities of financial institutions along a supply chain?
