    Ämnet för uppsatsen är likabehandling kontra positiv särbehandling och syftet är att undersöka rättsläget avseende utrymmet för positiv särbehandling i svensk rätt i ljuset av EU-rätten.

     

    Det finns ingen allmängiltig likabehandlingsprincip i Sverige som alla aktörer har att rätta sig efter. Dock är offentliga organ ålagda att i sin verksamhet iaktta saklighet och opartiskhet enligt 1 kap 9 § regeringsformen, d.v.s. behandla alla objektivt. Likabehandlingskravet finns endast som en del av saklighetskravet. För privata aktörer, såsom arbetsgivare inom den privata sektorn, finns förbud att diskriminera personer på vissa i diskrimineringslagen uppräknade grunder. Av förarbeten till lagen framgår att rätten att inte diskrimineras är en grundläggande mänsklig rättighet. Syftet med skyddet i lagen är att ge ett ökat rättskydd, bidra till att kränkta människor får upprättelse och leda till ökad jämlikhet och stärkt jämställdhet mellan män och kvinnor.

     

    Undantag från likabehandlings- och icke-diskrimineringsprincipen kan göras för vissa samhällintressen, såsom att skapa jämställdhet. Därför är det enligt svensk rätt tillåtet att positivt särbehandla en person på grund av kön om syftet är ökad jämställdhet. Undantaget har funnits sedan slutet av 1980-talet och stämmer väl överens med EU-rätten, som också tillåter positiv särbehandling. Undantaget i diskrimineringslagen ska dock tillämpas restriktivt och gäller endast om två konkurrerande av olika kön har likvärdiga eller i det närmaste likvärdiga meriter. Vidare måste en bedömning göras av personernas meriter och personliga förhållanden och åtgärden måste vara proportionerlig i förhållande till ändamålet.

     

    Frågan om samma undantag kan tillämpas för diskrimineringsgrunden etnicitet på statliga högskolor har prövades i svensk rätt 2006 och Högsta domstolen kom i det fallet fram till att den positiva särbehandling som tillämpades på juristutbildningen vid Uppsala universitet var otillåten, då de sökande, vilka var födda utomlands eller hade två föräldrar födda utomlands, som antagits i den särskilda kvoten haft sämre meriter än två sökande med svensk etnicitet. Högsta domstolen kallar detta för stark eller kvalificerad positiv särbehandling. I den då gällande lagen om likabehandling av studenter fanns ett undantag som inte tog sikte på någon särskild diskrimineringsgrund. Mot bakgund av detta och praxis från EU-domstolen kan svag positiv särbehandling ha varit tillåten i högskolesektorn vid tillfället som fallet prövades. Motsvarande undantag finns dock inte i den diskrimineringslag som trädde i kraft 2008 och som ersatte bl. a. likabehandlingslagen, vilket torde innebära att Högsta domstolens praxis i den frågan inte gäller längre. Det fanns dock förslag om att införa möjlighet till positiv särbehandling i arbetslivet från den kommitté som utredde frågan 2006, men kommittén föreslog inte samma möjlighet för utbidlningsområdet, då den menade att andra aktiva åtgärder är mer lämpade att använda för att bredda rekryteringen till högskolan, något högskolorna har en skyldighet till enligt högskolelagen. Det finns utrymme att införa regler om positiv särbehandling i EU-rätten, men reglerna är formulerade så att de medger medlemstaterna en möjlighet att göra det och inte en skyldighet.

    Today, VAT fraud is a widely spread problem among intra-Community trade. Due to the growth of the common market and the structure of the harmonized VAT system, new forms of VAT fraud have arisen. The opening of the common market, in 1993, led to the abolition of physical border controls. The combination of physical and administrative controls was replaced by only administrative control.

    Until the VAT system is completely harmonized the principle of destination will be applied to intra-Community business-to-business transactions. Regulations on intra-Community transactions have been developed to avoid double taxation. These regulations mean that the purchaser will be taxed in its state of origin, and that the seller will be exempted from taxation in its state of origin.

    Carousel fraud is a form of VAT fraud that makes use of the VAT system and the lack of exchange of information between the member states. In general terms VAT fraud can be described as transactions with the same goods that are being sold at high speed between different companies in different countries. In connection to these sales one or more of the companies do not pay the output VAT, at the same time other companies in the chain of supply have the right to deduct input VAT. Due to this, the state will loose VAT revenues. Carousel fraud has been dealt with in EC case law. It is established in the Optigen judgment that the right, of a taxable person, to deduct input VAT cannot be affected by any other taxable person’s fraudulent behavior in the chain of supply as long as the taxable person did not know or have any means of knowledge of the fraud in question. The Kittel judgment states that a taxable person, who knew or should have known that, by his purchase, he was participating in a transaction of VAT fraud, should be seen as a participant in that fraud and therefore be refused entitlement to the right to deduct.

    This thesis examines whether the principle of prohibiting abusive practice is applicable to carousel fraud. The Halifax judgment states that the principle also applies to the sphere of VAT. The principle of prohibiting abusive practice has been developed to attack transactions of purely artificial nature, which only purpose is to obtain advantages by abusing the Community law. However, our conclusion is that the principle of prohibiting abusive practice cannot be applied to anyone in a chain of transactions that constitutes carousel fraud. Our opinion is that neither a taxable person in god faith nor a taxable person in bad faith can meet the criteria of the principle.

    There are different ways to approach carousel fraud. Within the EC, exchange of information and various organisations for anti fraud are being used to deal with the problem. The member states have also, in various ways, tried to handle carousel fraud. They have for example used reverse charge and joint liability. We believe that administrative measures are crucial to combat carousel fraud. More radical alternatives such as reverse charge and joint liability should not be used unless it is obvious that the administrative measures do not suffice.

    Abstract [en]

    Due to the fact that the Swedish tax authority had paid attention to the issues concerning tax avoidance with the use of interest deduction, the first Swedish rules on interest deduction limitations on intra-group loans were introduced for associated companies in 2009. These rules were inspired by the equivalent Dutch rules on interest deduction limitations. Since the tax avoidance continued, the scope of the Swedish interest deduction limitation rules were extended in 2013. However, it has been shown that due to the formulation and the scope of the current Swedish rules, the legislation causes both interpretation issues and continuing tax avoidance. This thesis aims at examining the outcome of introducing similar rules as the Dutch interest deduction limitation rules in Sweden, instead of the current Swedish legislation, in order to analyze which of these legislations that better fulfills the purpose of the Swedish rules on interest deduction limitations. The thesis shows that there are both similarities as well as differences, with regards to both the formulation and the scope, between the Swedish and the Dutch rules on interest deduction limitations. It appears in the thesis that the differences in every provision of the Dutch legislation do not provide a possible solution to the remaining issues with the Swedish rules on interest deduction limitations. The author of the thesis considers a mixed application, containing some current Swedish provisions and some selected provisions similar to the Dutch provisions, to better fulfill the purpose of the Swedish rules on interest deduction limitations.

    Abstract [en]

    This article describes the Swedish rules about experiments on animals and the function of the Swedish animal ethics experimentation committees. A small survey of the rules about experiments on animals in Norway, Denmark, Finland, England and Wales, and the EU, is included. The Swedish rules on animal experimentation are examined in order to see how their form and functions relate to theories about different kinds of decision making in public law. The extents to which the rules agree with the aims of the law and with existing normative patterns are also examined. The difficulties to handle the ethical weighting between the importance of the experiment and the suffering of the animals are discussed.

    Abstract [en]

    In Sweden cruelty to animals can be penalized according to chapter 16, section 13 of the Penal Code (1962:700). Since the law demands the cause of the cruelty to be improperly, the crime often includes a weighting between the suffering of animals and the grounds of human behaviour that caused the suffering. The aim of this article is to study difficulties in the weighting between these factors. Methods of legal dogmatism, legal history and history of ideas are used. The article finds that suffering of animals and grounds of human behaviour often can be seen incommensurable factors, and that weighting between these factors therefore depends on the values of the person making the decision.

    Abstract [en]

    The purpose of this project is to study the Swedish Parliamentary Ombudsman Institution (JO) and its supervision of civil servants in the 20th century. Liability for misuse of office, the obedience obligation and the shaping of the principle of independence will also be considered. The study proceeds from a jurisprudential framework and is based on a legal dogmatic approach, although statistical information and other materials from the social sciences are also included. The findings of the study are as follows. The abolition of criminal liability for misuse of office in the mid-1970s resulted in a termination of the relationship which originally existed between civil servants’ authority under the principle of independence on the one hand, and their liability for service irregularities on the other. As a result, this reform entailed a pervasive change in one of the mainstays of the Swedish administrative model. The change was however of marginal importance to the activities of the JO, since a small and extraordinary office cannot effectively enforce legality and civil rights within a large public sector by initiating proceedings and demanding liability for committed errors. During the latter part of the 20th century, the JO thus evolved from having been a prosecutor who ensured that civil servants did not neglect their official duties into serving as a source of preventive guidance for government and municipal agencies. The question of how congruence is to be achieved between the civil servants’ liability for service irregularities and the powers of public authority is however, given the findings of this study, still largely unanswered.

    Abstract [en]

    Territorial rights are important for the Sámi people, as they are for all indigenous peoples. Land is the asset which supports the Sámi culture and responsible for its long-standing survival. This article compares property laws in Norway, Sweden and Finland as to how Sámi rights to land and natural resources are articulated and recognized. These rights are based on old doctrines: ‘immemorial usage’ in Norway and ‘immemorial prescription’ in Sweden and Finland. Although the doctrines are generally regarded as equivalent, the article discusses a few significant differences. Subsequently the basic principles underpinning the two doctrines are analyzed, contrasted and discussed, with particular focus on reindeer herding rights.

    The needs of indigenous peoples are related to land, water and other natural resources for sustaining a more or less traditional livelihood. Such needs typically compete with other societal interests. There are, on the one hand, specific interests in exploiting natural resources within traditional indigenous areas, while, on the other hand, concerns regarding conservation and preservation measures of valuable nature areas. This thesis contains two perspectives: an environmental protection perspective and a customary rights perspective. The thesis also contains a comparison of certain aspects of the law in Aotearoa/New Zealand, Canada and Sweden. Although the examination has a comparative approach, Swedish law is in prime focus. The objective is twofold. On the one hand, it includes an analysis of the interface between Saami customary rights, foremost the reindeer herding right, and environmental protection and natural resources legislation. On the other, it analyses and discusses ways in which the legislation may contribute to a sustainable use of land and natural resources within the reindeer herding area in Sweden. In this way, the second part of the objective is a succession of the former. It includes, above all, discussions de lege ferenda with the focus on Swedish environmental law. Evidently, it is the reindeer herding area per se that is in prime focus. Inherent in the examination as a whole, there are, hence, sustainability aspects. A correct comprehension of Saami customary rights is also important to the promotion of a sustainable use of the reindeer herding area. The interrelation of the two legal areas, environmental/natural resources law and aspects of the indigenous law, is, however, more evident with respect to the New Zealand and Canadian laws. Nevertheless, the connection also exists in a Swedish legal context, even though not as emphasised. Hence, there may be a call for a greater interrelation of these two legal areas. While general environmental requirements on the reindeer husbandry are abundant, specific requirements relating to regional or local circumstances are scarce. Such specific provisions may be designed to promote sustainability objectives better and, at the same time, to take into account specific Saami interests. Given the many conflicting land uses in the reindeer herding area, a stricter order of preferences taken on a strategic level generally provides advantages. Now, decisions are commonly left to be solved on a case by case basis with little guidance. Despite many shortcomings in specific legislation, above all, a regional and comprehensive environmental planning would greatly support the goal of sustainable uses of the land and resources in the area.
