    Abstract [en]

    Using longitudinal data on labour law in France, Germany, Japan, Sweden, the United Kingdom and the United States over the period 1970-2010, the authors estimate the impact of labour regulation on unemployment and the labour share of national income. Their dynamic panel data analysis distinguishes between the short-run and long-run effects of regulatory change. They find that worker-protective labour laws in general have no consistent relationship to unemployment but are positively correlated with labour's share of national income. Laws specifically relating to working time and employee representation are found to have beneficial effects on both efficiency and distribution thus proxied.

    Abstract [sv]

    I rapporten undersöks om och på vilket sätt förekommande kollektivavtal bidrar till förkortning av arbetstiden respektive ger möjlighet till flexibla arbetstidslösningar. När det gäller flexibla arbetstidslösningar försöker vi även beskriva i vilken utsträckning lösningarna tillgodoser företagens behov, t.ex. genom ökade möjligheter till varierad arbetstid, respektive ger enskilda arbetstagare ökade möjligheter att förena arbete, familj och fritid. Frågan är med andra ord hur dessa skilda intressen, verksamhetsintresset och arbetstagarintresset, balanseras i förekommande kollektivavtal. Undersökningen omfattar såväl centrala avtal som lokala lösningar.

    Flertalet centrala kollektivavtal anger att ordinarie arbetstid är högst 40 timmar per vecka och att arbetstidens förläggning bestäms av arbetsgivaren efter samråd med det lokala facket. Det förekommer avtal med kortare arbetstid eller olika flexibla lösningar, men dessa framstår alltjämt som undantag. För att finna exempel på nyare arbetstidsformer med antingen kortare arbetstid eller mer flexibel förläggning av arbetstiden får man i första hand söka efter arrangemang på lokal nivå.

    De lokala lösningar vi studerat uppvisar påtagliga skillnader mellan privat och offentlig sektor. I vissa kommuner finns lösningar vars huvudsakliga innebörd är en förkortning av arbetstiden utan sänkning av lönen. Dessa har i flertalet fall genomförts utan samband med t.ex. förändrade produktionsformer eller ändringar i arbetstidens förläggning. De lokala lösningar vi studerat på den privata sidan uppvisar ett annat mönster. Här är flertalet av de studerade lösningarna istället inriktade mot att åstadkomma ett flexibelt utnyttjande av arbetsetiden i syfte att effektivisera produktionen. De lösningar som huvudsakligen innebär en förkortning av arbetstiden är få. Där sådana har införts är dessa regelmässigt kopplade till olika förändringar i produktionen eller liknande. Dessa skillnader mellan offentlig och privat sektor kan förklaras av de skilda syften som legat bakom lösningarnas genomförande.

    Abstract [en]

    In this thesis, the author examines the. extent to which the Swedish Labour Courtaccords significance to individual employment contracts, and other factors personal tothe employer and employee, in determining the content of the employmentrelationship (i.e. the rights and duties of the parties).

    The first task is to establish the limits of the parties' freedom of contract. Rulesprovided for by statute, collective agreement and case law may be either mandatory ordefault rules. A default rule governs the parties' relationships unless they, explicitly orimplicitly, contract out of it. The question here is how to determine whether aparticular rule is mandatory or a default rule.

    Even mandatory rules, however, can leave a certain amount of space for individualcontracts. Normally, a mandatory rule is only aimed at contractual clauses whichinvolve disadvantages for one party. In addition, the mandatory character of the ruleusually ceases at a certain point of time, e.g. when the right which the rule grants oneof the parties has come into being.

    When the default character of a rule has been confirmed, the next question is underwhich circumstances the parties to an individual employment contract can be assumedto have exercised their right to diverge from that which is set out in the rub.

    These are the central legal questions in the thesis. The main place to look for answersto these questions is in the case law of the Labour Court. This collected case law isexamined with three different purposes in mind. The primary purpose is to analyse thecontent of the law as it is today (the lex lata). A second purpose is to compare thesolutions reached in the case law of the Labour Court in this area to those reached inother areas of the law of contracts. Finally, an attemt is made to shed tight on theunderlying goals of the case law of the Labour Court, in other words, the valueswhich this case law seeks to protect.

    Abstract [sv]

    EG:s företagsöverlåtelsedirektiv (2001/23/EG) syftar till att skydda arbetstagares ställning vid övergång av verksamhet. Direktivet har i Sverige genomförts genom ett flertal bestämmelser i anställningsskyddslagen och MBL. I artikeln diskuteras hur direktivet skall tillämpas vid internationella — gränsöverskridande — företagsövergångar. Analysen visar att direktivet i princip är tillämpligt vid sådana. Eftersom direktivet skall genomföras i

    nationell rätt, är det fråga om skilda nationella regler om företagsövergångar, låt vara att dessa delvis är harmonierade. En central fråga är därför vilket lands lag som skall tillämpas, liksom vilket lands domstolar som är behöriga att pröva tvister i anledning av gränsöverskridande företagsöverlåtelser.

    Abstract [en]

    This article deals with the rules designed to enforce European Union labour law in the workplace. Directives do not normally provide specific rules on procedures and sanctions according to which their substantive provisions are to be enforced. Instead, domestic rules are to be applied. The European Court of Justice, however, has developed some requirements that limit the autonomy of the Member States in this area. The aim of this article is to evaluate the principle of effective enforcement in the field of labour law, in the light of actual enforcement procedures in the Member States.

    Abstract [en]

    Swedish contract law has developed with the sale of goods on the commodity market as its social model. There are, however, several important differences between the ways in which sales of goods and employment relationships are organised. Sales of commodity are typically momentary transactions in which the identity of the parties is regarded as irrelevant. The employment contract is a long-term contract. It is dynamic in the sense that both parties typically intend the content of the contract to change. Further, the parties are not easily exchangeable.

    Another difference is that in traditional contract law the parties are assumed to have equal bargaining power, while in labour law the basic assumption stipulates that employees constitute the weaker party and that they are therefore in need of protection. The aim of the report is to discuss the ways in which these differences are reflected in the legal regulation of the employment contract, together with the corresponding questions regarding other types of contracts sharing some of the characteristics of the employment contract, such as franchise contracts, residential lease contracts and different types of consumer contracts.

    In section 2 a comparison of the main actors regulating the different contract types are made, and types of regulatory measures which are commonly used is described. Section 3 deals with contract forms. Section 4 describes the principles of general contract law concerning the duration of long-term contracts and the ways in which these principles can be amended in order to give one party an option to maintain the contract relationship. Section 5 deals with changes in the terms of long-term contracts.

    Arbetsgivare har ett starkt intresse att kunna anpassa arbetsstyrkans storlek efter varierande behov. I denna artikel analyseras samspelet mellan olika regelsystem som omgärdar arbetsgivares möjligheter att variera arbetsstyrkans storlek, dels tillfälligt dels till följd av säsongsmässiga variationer. Som utgångspunkt för analysen tas den värdering som kommer till uttryck i anställningsskyddslagen: att bruket av tidsbegränsade anställningar bör motverkas i syfte att bereda arbetstagare anställningstrygghet. En fråga är om den rättsliga regleringen i övrigt bidrar till eller motverkar att detta ändamål uppnås. Analysen visar att regleringen skapar incitament såväl för arbetsgivare som för arbetstagare att i vissa situationer välja tidsbegränsade anställningar framför tillsvidareanställningar.
