Abstract [sv]

Inom ramen för Sveriges regerings mål om offentlig upphandling ska upphandlande myndigheter bland annat klargöra hur de bidrar till hållbar utveckling. Offentlig upphandling kan därmed ses som ett strategiskt verktyg för att nå ett flertal samhällspolitiska mål om en långsiktigt hållbar utveckling. Upphandlande myndigheter i Sverige köper årligen in varor och tjänster till ett värde av mer än 500 miljarder kronor. Genom att myndigheter väljer leverantörer som arbetar med miljöhänsyn och sociala hänsyn, bidrar upphandlingen direkt till en hållbar utveckling. Denna studie behandlar sociala krav i offentlig upphandling; i vilken utsträckning och på vilket sätt de används samt hur sådana krav följs upp. Studien är gjord med hjälp av intervjuer och en enkätundersökning riktad till svenska myndigheter. Syftet har varit att kartlägga den offentliga sektorns arbete avseende sociala krav i upphandling. Resultatet av studien visar att svenska myndigheter saknar en gemensam bild av vad sociala krav innebär. Endast ett fåtal ställer dessa krav i sina upphandlingar då rådande lagstiftning gör det kostsamt och resurskrävande. Kraven måste dessutom stå i proportion till upphandlingens natur och följas upp för att kunna ställas.

Abstract [en]

The Swedish government’s target in matters of public procurement is that the contracting authorities, among other things, have to clarify how they contribute to sustainable development. Public procurement can therefore be seen as a strategic tool to achieve several public policy goals of sustainable development. Contracting authorities in Sweden annually buys goods and services valued at more than SEK 500 billion. By selecting suppliers who work with environmental and social considerations the procurement directly contributes to sustainable development. This study treats social requirements in public procurement; to what extent and in what ways they are used and how such requirements are followed up. The study was performed through interviews and a survey directed to Swedish authorities. The aim has been to investigate how the public sector handles social requirements in contracts. The results of this study show that Swedish authorities lack a common view of what social requirement means. Only a few places these requirements in their procurements since current laws make it costly and resource intensive. The requirements must also be proportionate to the nature of the contract and follow-up work needed to be performed in order to make such demands.
