Abstract [sv]

Syftet med uppsatsen är att, mot bakgrund av det ökade terrorhotet mot Sverige utredahuruvida terrorhotet faller inom ramen för rikets säkerhet i 2 kap. RF och nationellsäkerhet i EKMR. Dessutom ämnas att besvara frågan huruvida förslaget i SOU 2024:52om ändring i 2 kap. 10 § OL, avseende nekande av tillstånd för allmänna sammankomstermed hänsyn till rikets säkerhet, förhåller sig till artikel 10 och 11 EKMR. Vid besvarandetav frågeställningarna används både en rättsdogmatiskt och en rättsanalytisk metod. Avanalysen framgår att terrorhotet omfattas av både rikets säkerhet i 2 kap. RF och nationellsäkerhet i artikel 10 och 11 EKMR. Vidare framgår att Förslaget om ändring i 2 kap. 10§ OL i SOU 2024:52 är förenligt med artikel 10 och 11 EKMR.

Abstract [en]

The purpose of this thesis is, considering the increased terrorist threat against Sweden, toinvestigate if the terrorist threat falls within the scope of national security in Chapter 2 ofthe Instrument of Government and national security in the European Convention onHuman Rights (ECHR). Furthermore, the aim is to answer the question if the proposal inSOU 2024:52 regarding the amendment of Chapter 2, Section 10 of the Public Order Act,concerning the denial of permits for general assembly on the grounds of national security,is compatible with article 10 and 11 in the ECHR. In answering these questions, both alegal dogmatic and a legal analytical method are employed. The analysis demonstratesthat the terrorist threat is encompassed by both national security in Chapter 2 of theInstrument of Government and the ECHR. Furthermore, it confirms that the proposal toamend Chapter 2, Section 10 of the Public Order Act in SOU 2024:52 is in accordancewith article 10 and 11 in the ECHR.
