Traces of the Bible in Swedish Law (English)
Abstract [en]

In this work, the main question is posed, regarding the presence of potentialeffects of the Bible on Swedish law, and how such effects may and ought to beexpressed within the system for current and future use. The question is partiallyanswered through the application of a method of historical jurisprudence, whichaims to identify general, historically valid principles that have enabled the survivalof biblically inspired legislation and methodology in Swedish history. Any suchprinciples, that are identified throughout the work, are then applied on modernbiblical expressions within the Swedish legal system, to determine how these expressions may maintain or gain their usefulness in Swedish law. Furthermore, thegeneral connection between law and morality is researched, to determine howbiblically inspired morality may and ought to influence Swedish law.The conclusions of the thesis are that the expressions of the Bible within themodern Swedish legal system, such as the human rights, which are legally bindingin Sweden through the Convention for the Protection of Human Rights andFundamental Freedoms, and biblically inspired morality, ought to be interpretedin a way that enables these expressions to be useful for societal needs and change.The biblical connection is a historical fact, but it should not cause the rules andmoral values to be bound in interpretation to their historical, biblical purposes inperpetuity. Interpreting the biblical expressions in this manner would make themstagnate and would hurt their quality as legal rules to be applied over an extendedtimeframe.
