Abstract [sv]

Denna studie undersöker hur barns delaktighet skrivs fram i domar som rör umgänge med en våldsutövande pappa. Studien undersöker även hur barnets bästa bedöms i dessa domar. Det empiriska materialet har begärts ut av tingsrätter och resultatet har granskats med en tematisk analys. Resultatet visar på att barn sällan får komma till tals själva i umgängesfrågan utan det vanligaste är att barns röst formuleras av en vuxen, oftast en förälder. Barnets bästa bedöms olika och resultatet visar även att det barnet själv vill sällan är en avgörande del i denna bedömning. I diskussionen presenteras möjliga slutsatser att det bland annat brister i barns delaktighet och det förs även ett resonemang om begreppet barnets bästa samt hur detta i praktiken används i bedömningen. Det förs även en diskussion om barns nära kontakt med båda sina föräldrar i relation till risken att bli utsatt för våld. Studien presenterar även förslag på vidare forskning.

Abstract [en]

This study investigated children's participation in court orders concerning companionship with a violent father. This study also looks into how the best interests of the child are decided in these orders. The empirical material consists of juridical orders and have been requested from different courts in Sweden. The results have been analyzed through a thematic-analysis. Results show that children's opinions most often are presented by an adult, usually by one of their parents. The best interest of the child is differently estimated and the result shows that children's opinions rarely play a defiant role when the court motivates a decision concerning companionship. In the discussion you can find possible conclusions about lack of children's participation and different motivations about the best interests of the child and how it is used in practice when coming to a legal conclusion. Another discussion is held about children's need for close contact with both their parents, compared to the possible risk of violence. The study also presents examples of further research.
