In this thesis work, I focused on TRIPS Agreement, as well as its effects on developing countries in the pharmaceutical field. The aim of the work consisted of examining whether the TRIPS Agreement disadvantages developing countries from the perspective of human rights. To analyze the TRIPS Agreement, the legal tools and the literature overall, pluralistic theories were used. HRBA, or Human Rights-Based Approach was used to assess the TRIPS Agreement and other legal tools, such as UDHR and ICESCR. The results showed that the TRIPS Agreement put developing countries, such as India, Brazil, Russia and South Africa in a disadvantaged position. Thus, it was concluded that the implementation of the Agreement was not necessary and the progress in the IP sphere was stagnated for developing countries.
