Abstract [en]

The purpose of this study is to illustrate a picture of how mothers and fathers are described in court when they rule in sole custody battles. The aim has also been to investigate if mothers or fathers is aggrieved differently due to their gender. Our material consists of six legal cases from the Court of Appeal and the District court. In this study we´ve used qualitative method and applied a text analysis, when analysing  our empirical data we've used gender theory and social construction. Previous studies shows on one hand that there are different assessment criteria when the social welfare investigate mothers and fathers, this investigation is included in the court's decision. On the other hand studies shows that the court don´t take the parent's gender in account when they rule for sole custody. The result of our study shows that the court don't take the parent's gender in account when they rule in custody battles. However we found differences in how mothers and fathers are represented in the court's investigation.
